GDPR Privacy Policy

Anch is committed to the lawful and responsible collection and processing of your personal information. This privacy policy outlines Anch’s practices in this regard. Anch processes personal information in accordance with the regulations and directions set out in Regulation (EU) 2016/679 (General Data Protection Regulation).
  1. Personal Information
 
  1. Personal information includes any information which identifies you as a unique individual. We will request certain fundamental personal information when you register as a user of the App and thereafter, you may be requested to furnish additional personal information necessary for certain specific functionalities and/or services offered in the App. The requested personal information may include your:
 
  1. name and surname
  2. identity number
  3. date of birth
  4. gender
  5. mobile number
  6. email address
  7. physical address
  8. vehicle registration plate number
  9. property tax (and related account) information
  10. location
 
  1. If you choose to provide us with your personal information, you agree to provide accurate and current information and not to misrepresent yourself in any way. Please inform us as soon as reasonably possible of any changes to your personal information so that we may make the appropriate updates to our records.
 
  1. The general purposes for which Anch collects and processes your personal information includes, but are not limited to the following:
 
  1. the delivery of products, services and/or functionality offered through the App, which includes but is not limited to, fault logging, account balances and payments, bookings, events, insurance, notifications, emergency contacts and access control;
 
  1. to contact you for the delivery of relevant information or notices;
 
  1. to inform you of current or new products or services, features, special offers and promotional competitions offered by us or any of our partners and/or product or service providers (unless you have opted out of receiving marketing material from us); and
 
  1. to improve our product and service selection and your experience of our App service by, amongst other things, monitoring your in-App activity and/or tracking your purchases on the App.
 
  1. Your Rights
 
  1. You have the following, non-exhaustive, rights regarding your personal information:
 
  1. Information regarding your data processing: You have the right to obtain from us all the requisite information regarding our data processing activities that concern you (Articles 13 and 14 GDPR).
 
  1. Access to personal data: You have the right to obtain from us confirmation as to whether or not personal data concerning you are being processed, and, where that is the case, access to the personal data and certain related information (Article 15 GDPR).
 
  1. Rectification or erasure of personal data: You have the right to obtain from us the rectification of inaccurate personal data concerning you without undue delay, and to complete any incomplete personal data (Article 16 GDPR). You may also have the right to obtain from us the erasure of personal data concerning you without undue delay, when certain legal conditions apply (Article 17 GDPR).
 
  1. Restriction on processing of personal data: You may have the right to obtain from us the restriction of processing of personal data, when certain legal conditions apply (Article 18 GDPR).
 
  1. Object to processing of personal data: You may have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you, when certain legal conditions apply (Article 21 GDPR).
 
  1. Data portability of personal data: You may have the right to receive your personal data in a structured, commonly used and machine-readable format, and have the right to transmit those data to another controller without our hindrance, when certain conditions apply (Article 20 GDPR).
 
  1. Not to be subject to automated decision-making: You may have the right not to be subject to automated decision-making (including profiling) based on the processing of your personal data, insofar as this produces legal or similar effects on you, when certain conditions apply (Article 22 GDPR).

  1. App Functionality
 
  1. The App requires accurate and complete records of certain personal information to function optimally. If you:
 
  1. provide us with incorrect or incomplete personal information; or
 
  1. withdraw your consent for us to process your personal information; or
 
  1. request that we delete or destroy your personal information;
 
the functionality and reliability of the App and the products/services offered in the App will be reduced and/or negatively affected.
 
  1. The App collects location data to enable access control functionality even when the App is closed or not in use.
 
  1. Disclosure of Personal Information
 
  1. Anch will not, without your express consent, disclose your personal information to any third-party, other than:
 
  1. to our employees or contractors;
 
  1. when we are legally obliged to do so, to: law enforcement; government officials; fraud detection agencies; or other third-parties when we believe in good faith that the disclosure of personal information is necessary to prevent physical harm or financial loss;
 
  1. to our partners who supply goods and services though the App or who are engaged with our business operations; and
 
  1. to third-party goods and service providers in order for them to liaise directly with you in the event of you submitting a complaint or claim regarding any order you have placed which requires their direct involvement.
 
  1. We will ensure that all our employees, contractors and partners (including their employees and third-party service providers) having access to your personal information are bound by appropriate and legally binding confidentiality obligations in relation to such information.
 
  1. General
We will -
  1. treat your personal information as strictly confidential, save where we are entitled to share it as set out in this Privacy Policy;
 
  1. take appropriate technical and organisational measures to ensure that your personal information is kept secure and is protected against unauthorised or unlawful processing, accidental loss, destruction or damage, alteration, disclosure or access;
 
  1. provide you with access to your personal information to view and/or update personal details;
 
  1. promptly notify you if we become aware of any unauthorised use, disclosure or processing of your personal information;
 
  1. provide you with reasonable evidence of our compliance with our obligations under this Privacy Policy on reasonable notice and request;
 
  1. upon your request, promptly return or destroy any and all of your personal information in our possession or control, save for that which we are legally obliged to retain;
 
  1. not retain your personal information longer than the period for which it was originally needed, unless we are required by law to do so or you consent to us retaining such information for a longer period;
 
  1. do all things reasonably necessary to protect your rights of privacy.
 
 
  1. Limitation of Liability
ANCH SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE, HOWSOEVER ARISING, SUFFERED BY YOU AS A RESULT OF:
  1. the unauthorised or unlawful disclosure of your personal information, whilst in our possession, unless such disclosure is as a result of our wilful conduct or gross negligence; and
 
  1. your disclosure of your personal information to a third-party, such as an entity partnered with Anch or an entity which operates a website linked to the App, or anyone other than Anch.
 
  1. Children
We do not knowingly collect and process information on children under sixteen (16) without permission and consent of their parent(s). If we discover that we have collected and processed the personal data of a child under sixteen (16) directly, or the equivalent minimum age depending on the concerned jurisdiction, we will take steps to delete the information as soon as possible. If you become aware that a child under sixteen (16) has provided us with personal data directly, please contact us immediately by using the contact address specified under this Privacy Policy.
  1. Consent
 
By using the App, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us.
 
  1. Opt-out
 
You can stop all collection of information by the App easily by uninstalling the App. You may use the standard uninstall processes as may be available on your device. If you have also consented to receiving marketing promotions you can unsubscribe from these on any of the marketing messages.
 
  1. Changes
 
This Privacy Policy may be updated from time to time for any reason without notice. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.
